The Probate Avoidance Trust is for those who want to avoid a Colorado probate, but are not really seeking asset protection and prefer to eventually leave their assets outright and free of trust to their beneficiaries.  Additional information about the Probate Avoidance Trust includes:

•   Distributions are to be made for health, education, maintenance or support

•   Ability to included phased outright distributions.  For example, 1/3 of the assets can be distributed  at age 30, another 1/3 at the age of 35 and the final 1/3 at the age of 40

•   The Trust terminates upon a certain age or upon the death of a beneficiary

•   For married couples, it provides marital estate tax planning

•   Includes Special Needs Trust provisions in case your child is disabled and needs to qualify for Medicaid benefits

•   Contains special language so the trust can hold retirement plan assets
